Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of LocalJobSpot.com and any related websites, pages, features, content, communications, and services that link to these Terms (collectively, the "Services"). The Services are operated by LocalJobSpot.com ("LocalJobSpot," "Company," "we," "our," or "us").

By accessing or using the Services, submitting information, creating an account, or otherwise interacting with the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE DISCLAIMERS, LIMITATIONS OF LIABILITY, AN INDIVIDUAL ARBITRATION AGREEMENT, A CLASS-ACTION WAIVER, AND A JURY-TRIAL WAIVER.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and may provide additional notice where required by law. Changes become effective when posted unless a later effective date is stated. Changes to dispute-resolution provisions will not apply retroactively to disputes that arose before the updated terms became effective.

Eligibility

You must be at least eighteen (18) years old and legally capable of entering into a binding contract to use the Services. The Services are intended for users located in the United States. By using the Services, you represent that you meet these requirements.

Description of the Services

LocalJobSpot provides job-related information, job listings, employment resources, advertisements, matching tools, and links or connections to employers, staffing agencies, recruiters, job marketplaces, service providers, and other third parties.

LocalJobSpot is not an employer, staffing agency, recruiter, employment agency, or agent of any employer unless expressly stated otherwise. We do not make hiring decisions, control employer practices, or guarantee that any user will receive an interview, job offer, employment, compensation, benefits, or any other employment outcome.

We may add, remove, suspend, modify, or discontinue any part of the Services at any time without liability, subject to applicable law.

No Employment Guarantee or Professional Advice

The Services are provided for general informational and connection purposes only. Job listings, compensation information, qualifications, employer descriptions, career information, and other content may be supplied by third parties and may be incomplete, inaccurate, outdated, misleading, or unavailable.

You are solely responsible for evaluating any job opportunity, employer, recruiter, staffing agency, service provider, or other third party before relying on information, submitting information, attending an interview, accepting an offer, making a payment, or taking any other action.

Nothing on the Services constitutes legal, financial, tax, immigration, employment, career, or other professional advice.

Third-Party Employers, Recruiters, and Job Listings

Employers, recruiters, staffing agencies, job marketplaces, advertisers, and other third parties are independent from LocalJobSpot. We do not control and are not responsible for their job listings, hiring standards, screening methods, communications, employment decisions, background checks, compensation, working conditions, products, services, privacy practices, or conduct.

LocalJobSpot does not independently verify every job listing, employer, recruiter, or third-party offer. You acknowledge that fraudulent, inaccurate, expired, duplicated, or misleading postings or communications may appear despite our efforts. You should never provide money, banking credentials, Social Security numbers, identity documents, or other sensitive information unless you have independently verified the recipient and the legitimate need for the information.

You should report suspicious listings or communications to info@LocalJobSpot.com and, when appropriate, to the relevant government or law-enforcement authority.

Registration and Account Security

Certain features may require registration or an account. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring through your account.

You must promptly notify us at info@LocalJobSpot.com if you suspect unauthorized access to or use of your account. We are not responsible for losses caused by your failure to secure your account or credentials.

User Information, Resumes, and Submissions

The Services may permit you to submit resumes, employment histories, applications, profiles, messages, reviews, feedback, or other information or materials (collectively, "User Content"). You retain any ownership rights you have in your User Content.

By submitting User Content, you grant LocalJobSpot a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, format, transmit, display, distribute, and otherwise use the User Content as reasonably necessary to operate, improve, promote, and provide the Services, fulfill your requests, and connect you with third parties in accordance with our Privacy Policy.

You represent and warrant that you have the right to submit the User Content, that it is accurate to the best of your knowledge, and that it does not violate any law, agreement, confidentiality obligation, intellectual-property right, privacy right, or other right of any person.

We may remove, restrict, or decline to distribute User Content at any time, but we are not obligated to monitor or review all User Content.

Privacy and Communications

Our collection, use, disclosure, and retention of Personal Information are described in our Privacy Policy, which is incorporated into these Terms.

When you submit an inquiry or request information, LocalJobSpot and the employers, recruiters, staffing agencies, advertisers, vendors, or other parties identified in the applicable form may contact you regarding that request as permitted by law.

Where you separately provide legally valid consent, you may receive calls or text messages using automated technology, prerecorded messages, or artificial voice technology. Consent to receive marketing calls or text messages is not a condition of purchasing any product or service.

SMS Terms

If you enroll in a LocalJobSpot text-messaging program, message frequency may vary and message and data rates may apply. You may opt out at any time by replying STOP. You may reply HELP for assistance or contact info@LocalJobSpot.com.

By enrolling, you represent that you are the subscriber or customary user of the mobile number provided, or that you are authorized by the subscriber to enroll the number. Carriers are not liable for delayed or undelivered messages. Availability may depend on your carrier and device.

If your mobile number changes, is reassigned, or is no longer used by you, you agree to promptly opt out or notify us.

Limited License

Subject to these Terms, LocalJobSpot grants you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Services for lawful, personal, and non-commercial purposes.

The Services, including their design, text, graphics, logos, trademarks, software, databases, features, and other content, are owned by or licensed to LocalJobSpot and are protected by intellectual-property laws.

Except for the limited license granted in these Terms, no right, title, or interest in the Services is transferred to you.

Third-Party Websites, Products, and Advertisers

The Services may contain links, advertisements, embedded features, offers, or content provided by third parties. LocalJobSpot does not control, endorse, or assume responsibility for third-party websites, content, products, services, security, or privacy practices.

Your dealings with third parties are solely between you and the third party. LocalJobSpot is not liable for losses or damages arising from those dealings.

Suspension and Termination

We may suspend, restrict, or terminate your access to the Services, remove content, or close an account if we believe you violated these Terms, pose a risk to the Services or others, engaged in fraudulent or unlawful activity, or for another lawful business reason.

Provisions that by their nature should survive termination, including intellectual-property, disclaimers, indemnification, limitations of liability, and dispute-resolution provisions, will survive.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." LOCALJOBSPOT DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, CURRENT, COMPLETE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY JOB LISTING, EMPLOYER, RECRUITER, MATCH, APPLICATION, INTERVIEW, OFFER, OR EMPLOYMENT OUTCOME WILL BE ACCURATE, LEGITIMATE, AVAILABLE, OR SUCCESSFUL.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LOCALJOBSPOT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, LOSS OF INCOME, LOSS OF EMPLOYMENT OPPORTUNITY, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO LOCALJOBSPOT DURING THE TWELVE MONTHS BEFORE THE CLAIM OR FIVE HUNDRED DOLLARS ($500).

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, these provisions apply to the maximum extent permitted by law.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless LocalJobSpot and its affiliates, officers, directors, employees, agents, licensors, service providers, and partners from claims, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys' fees arising out of or relating to:

Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO GO TO COURT, HAVE A JURY TRIAL, OR PARTICIPATE IN A CLASS ACTION.

Before starting arbitration, the party asserting a dispute must send a written Notice of Dispute describing the claim and requested relief. The parties will attempt in good faith to resolve the dispute informally for at least thirty (30) days.

Except for qualifying small-claims matters and requests for temporary or preliminary injunctive relief involving intellectual property, security, fraud, or unauthorized access, any dispute arising out of or relating to the Services, communications received through the Services, these Terms, or the Privacy Policy will be resolved through binding individual arbitration under the Federal Arbitration Act.

The arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless the parties agree to JAMS. It will be conducted by one neutral arbitrator, in English, and may take place by telephone, video conference, written submissions, or in person as permitted by the applicable rules.

ARBITRATION WILL PROCEED ONLY ON AN INDIVIDUAL BASIS. YOU AND LOCALJOBSPOT WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION.

The arbitrator may award any remedy available in court on an individual basis. The arbitrator's decision will be final and binding, subject to the limited review permitted by the Federal Arbitration Act.

A party may bring an individual action in small-claims court if the claim qualifies. Either party may also seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, security, or the integrity of the Services.

If any portion of the class-action waiver or individual-arbitration requirement is found unenforceable as to a particular claim or request for relief, that portion will be severed and resolved by a court after all arbitrable claims are completed.

Governing Law

These Terms and any dispute not subject to arbitration are governed by the laws of the State of California, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration provisions.

To the extent a dispute is permitted to proceed in court, the parties consent to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California, unless applicable law requires another venue.

General Provisions

These Terms and the Privacy Policy constitute the entire agreement between you and LocalJobSpot regarding the Services and supersede prior or contemporaneous understandings concerning the Services.

If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or other business transaction.

Headings are for convenience only. Electronic notices and records satisfy any legal requirement that communications be in writing.
